AgAnswers Beta Terms of Service

Welcome

We built AgAnswers to help farmers and agricultural organizations manage information, records, operations, and business decisions using modern software and artificial intelligence. These Terms explain how the Services work, what you can expect from us, and what we expect from you. By accessing or using AgAnswers, you agree to these Terms.

1. Beta Status

AgAnswers is currently offered as a beta service. Many features are actively being developed, tested, and improved. Features may change, move, be removed, or behave unexpectedly as we learn from customer feedback and real-world usage. The Services are provided for evaluation and feedback purposes and may be modified, suspended, or discontinued at any time.

2. Eligibility and Authority

You may use the Services only if you are legally able to enter into these Terms. If you access or use AgAnswers on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your Content and Data

"Customer Content" means any information, data, records, documents, files, images, photographs, videos, audio recordings, messages, communications, prompts, notes, forms, spreadsheets, field records, operational records, agronomic records, financial records, equipment records, farm records, metadata, and other content that is submitted, uploaded, entered, transmitted, generated, synchronized, imported, connected, or otherwise made available to the Services by you or on your behalf, whether directly or through a third-party integration.

Customer Content includes information obtained from connected third-party services, devices, platforms, software systems, equipment, sensors, or data providers that you authorize AgAnswers to access.

You retain ownership of Customer Content. AgAnswers receives a limited right to host, process, store, search, index, analyze, retrieve, transform, and create technical representations necessary to provide the Services. Customer Content is not used to train general-purpose AI models unless expressly disclosed otherwise.

4. License to Use the Services

AgAnswers grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services solely for your internal agricultural and business operations. You may not sublicense, lease, rent, distribute, transfer, assign, or otherwise make the Services available to third parties. Except for the limited rights expressly granted, AgAnswers reserves all right, title, and interest in and to the Services.

5. AI-Assisted Features

AgAnswers may generate agronomic recommendations, grain marketing analyses, operational recommendations, compliance guidance, financial insights, and other decision-support information. Such outputs are inherently uncertain and may be inaccurate, incomplete, or unsuitable for a particular farm, operation, field, crop, market condition, or circumstance.

6. Farming Decisions

You remain solely responsible for all farming and business decisions, including planting, harvesting, irrigation, fertilization, chemical application, livestock management, equipment operation, grain marketing, regulatory compliance, labor management, and financial planning.

7. Third-Party Integrations

You may connect third-party services. AgAnswers is not responsible for third-party products, services, platforms, or data sources.

8. Messaging Services

AgAnswers offers an SMS program for user-initiated conversational, account-related, and user-requested service notification messages related to the AgAnswers platform and a specific AgAnswers organization ("AgAnswers Conversational Messaging").

By opting in to SMS, you agree to receive text messages from AgAnswers from +1 217-217-2717 at the mobile number you provide. Message frequency varies based on your requests, usage, and support needs. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.

For organization-linked messaging, an authorized organization administrator may add your number for a specific AgAnswers organization. That provisioning step alone does not opt you in. You must text +1 217-217-2717 from that phone and complete the START or UNSTOP confirmation flow before ongoing SMS is enabled.

You are responsible for providing a mobile number that you control and for ensuring that you have authority to opt in for that number. You may opt out at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, QUIT, or STOPALL. For help, reply HELP or contact support@aganswers.ai.

Carriers are not liable for delayed or undelivered messages. We may suspend or terminate SMS access if we believe the program is being misused, consent is invalid, or continued delivery could create legal, compliance, or operational risk.

9. Beta Confidentiality

You agree not to publicly disclose non-public information regarding AgAnswers beta features, screenshots, demonstrations, pricing, roadmap information, or technical details without prior written consent.

10. Feedback

AgAnswers may use suggestions, ideas, feature requests, bug reports, and other feedback without restriction and without compensation.

11. Acceptable Use

You may not violate laws, interfere with operation of the Services, upload malicious code, attempt unauthorized access, bypass security measures, or use the Services to build competing products.

12. Availability, Export, and Deletion

AgAnswers cannot guarantee uninterrupted or error-free operation. Customers may request export or deletion of Customer Content subject to legal and operational requirements.

13. Suspension and Termination

You may stop using the Services at any time. AgAnswers may suspend or terminate access for violations, abuse, fraud, security concerns, or legal requirements.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."

15. Limitation of Liability

AgAnswers shall not be liable for crop loss, yield loss, lost profits, grain marketing losses, business interruption, equipment damage, regulatory penalties, or loss of data. Total liability shall not exceed the greater of amounts paid during the preceding twelve months or $100.

16. Governing Law

These Terms are governed by the laws of the State of Delaware.

17. Changes to These Terms

We may update these Terms from time to time. Continued use constitutes acceptance of revised Terms.
