Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, APIs, messaging features, and related services provided by AgAnswers AI, Inc. d/b/a AgAnswers ("AgAnswers," "we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms.

Eligibility and Authority

You may use the Services only if you are legally able to enter into these Terms. If you access the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Use of the Services

You may use the Services only in compliance with these Terms and applicable law. You are responsible for activity under your account, for maintaining the confidentiality of your credentials, and for providing accurate information needed to operate your account and requested features.

Customer Content

You retain your rights in the content, files, prompts, records, and other materials you submit to the Services. You grant AgAnswers a limited, non-exclusive right to host, process, transmit, and store that content solely as needed to provide, secure, support, and improve the Services for you and your organization.

AI-Assisted Features

The Services may include AI-assisted outputs and workflow support. Those outputs may be incomplete or incorrect and should be reviewed by the user before being relied on for operational, financial, legal, agronomic, regulatory, or compliance decisions. AgAnswers does not provide legal, tax, accounting, agronomic, or other professional advice through the Services.

Third-Party Integrations

You may choose to connect third-party services to AgAnswers. By doing so, you authorize us to access and process the data made available by those integrations as needed to provide the requested functionality. If you revoke or disconnect an integration, future access will stop, but content previously imported into the Services may remain until it is separately deleted.

SMS Program Terms

AgAnswers offers an SMS program for user-initiated conversational, account-related, and user-requested service notification messages related to the AgAnswers platform ("AgAnswers Conversational Messaging").

By opting in to SMS, you agree to receive text messages from AgAnswers at the mobile number you provide. Message frequency varies based on your requests, usage, and support needs. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.

You are responsible for providing a mobile number that you control and for ensuring that you have authority to opt in for that number. You may opt out at any time by replying STOP. For help, reply HELP or contact support@aganswers.ai.

Carriers are not liable for delayed or undelivered messages. We may suspend or terminate SMS access if we believe the program is being misused, consent is invalid, or continued delivery could create legal, compliance, or operational risk.

Acceptable Use

You may not use the Services to violate the law, infringe rights, interfere with the Services, attempt unauthorized access, transmit harmful code, or submit content that you do not have the right to use.

Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time. We work to make the Services reliable, but we do not guarantee uninterrupted or error-free operation.

Termination

We may suspend or terminate access to the Services if you violate these Terms, present a security or abuse risk, or use the Services in a way that could harm AgAnswers, its customers, or third parties.

Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AgAnswers disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, AgAnswers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, business interruption, or data, arising out of or related to the Services.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and provide additional notice where appropriate.
